1. General Information

This website is owned and operated by ROMANIA PUNCHIKADE. By using this website, you agree to these Terms and Conditions. If you do not agree with these terms, please do not use this site.

2. Purpose of These Terms and Conditions

These T&Cs explain your rights and obligations when using the website, registering an account (as a consumer or on behalf of a legal entity), and ordering products.

By using the website or creating a user account, you accept these T&Cs and our Privacy Policy (including cookie use). Together, these documents form a contract between you and ROMANIA PUNCHIKADE.

You confirm that you are at least 18 years old. If not, please do not use the website.

We recommend saving or printing these T&Cs (in the version available on the date of your order) as we may not keep copies or allow future access.

3. Changes to the T&Cs

We may amend these T&Cs periodically (to reflect legal, operational, or technological changes). When you revisit the website, please check the last update date and any changes.

Material changes will be notified via email or website notice before they take effect.

If you do not agree with changes, please stop using the website. Continued use after changes constitutes acceptance. Changes apply only to future orders, not those already confirmed.

4. Account Management

You can manage and update your user account details, correct errors, and reset your password via your account settings.

Accounts are personal and non-transferable. Do not share access with others. We reserve the right to suspend or close accounts if used improperly or in violation of these T&Cs.

5. Order Fulfillment

Orders depend on product availability. If a product is unavailable, we will notify you promptly, ideally before order acceptance. If you do not wish to wait, you may request a full refund within 7 calendar days after informing us.

6. Right to Withdraw

Consumers may withdraw (cancel) orders without reason within 10 calendar days, but only for specific product types (e.g., some kitchen equipment, physical books).

Withdrawal rights do not apply to:

• Perishable goods (food, supplements, fruits, etc.)

• Sealed products that cannot be returned for hygiene/health reasons once opened

• Products mixed inseparably after delivery

Product descriptions will clearly state if withdrawal is not allowed.

To withdraw:

• Notify us within 10 calendar days from receiving the product(s)

• Use the withdrawal form on the website or notify us by email, post, or fax before the deadline

7. Consequences of Withdrawal

• We will refund the product price plus standard delivery costs within 10 calendar days of withdrawal notification and receipt of returned products (or proof of return).

• Refunds use the original payment method unless otherwise agreed.

• You cover return shipping costs unless stated otherwise.

• Returned products must be in the same condition as delivered.

• Diminished product value caused by use beyond inspection may reduce your refund.

8. How to Return Products

• Fill out a return request

• Package products securely (original packaging preferred)

• Attach the return address label

• Contact support@romaniapunchikade.com to arrange courier pick-up

• You may choose an alternative return method with recorded delivery and proof of shipment

• Return any free promotional items received along with your order

9. Delivery

• Delivery via courier within:

  • 24 hours for orders placed by 2 PM (Mon–Thu)

  • Up to 48 hours for remote areas or orders after 2 PM

  • Monday delivery for orders placed Thu 2 PM – Fri 2 PM

  • Tuesday delivery for orders placed Fri 2 PM – Sun

• Delivery cost: 30 lei per delivery (VAT included), calculated by package weight

• Products arrive in original, sealed packaging

• Failed delivery notifications require you to arrange re-delivery with the courier

• We are not liable for delivery delays due to uncontrollable events (force majeure, transport conditions, stock issues, etc.)

10. Risks and Ownership

• Ownership transfers to you upon full payment including delivery fees

• Risk of damage or loss transfers upon delivery to you or your designated recipient (other than courier)

11. Product Presentation

We strive for accuracy in product images and descriptions, but minor differences (color, packaging, labeling) may occur.

12. User Content

You may post comments or reviews on products and blog posts, including social shares and likes.

Uploaded content must be accurate, lawful, and not infringe on others’ rights. Prohibited content includes defamatory, offensive, vulgar, racist, obscene, threatening, harassing, or privacy-invading material.

We reserve the right to remove any content violating these T&Cs without prior notice.

13. Promotions and Discounts

Promotions, contests, and discounts are offered at our discretion and will have separate terms displayed on the site.

14. Guarantees and Liability

Product Compliance and Warranty

• Consumers may request repair, replacement, or refund for non-conforming products within 10 days of notifying us.

• Products have a 2-year legal warranty, or less if typical usage duration is shorter.

• Manufacturer warranties apply if relevant.

• Warranty does not limit other legal rights.

Non-consumers (business buyers)

• Must inspect products immediately and report issues within 5 working days.

• Failure to report means acceptance of products.

15. Our Liability

Our liability is limited to the amount you paid for the products.

Liability is excluded if you:

• Continue using the product after notifying us of defects

• Fail to pay the full price on time

• Modify the product without consent

You indemnify us for damages caused by your T&C breaches.

For non-consumers, we are not liable for economic losses, reputation damage, or indirect/unforeseeable damages.
